This agreement applies between you as a creator and Cre8ify as soon as you open a shop. You accept it when you sign up.
1. Who
“Cre8ify” is [Company name], [address], Chamber of Commerce no. [KvK number]. “You” or “the creator” is the person or business that opens a shop. “Product” is any digital product you offer through Cre8ify.
2. How selling works
Cre8ify sells your products to buyers in its own name. So we are the seller: we receive the payment, issue the buyer’s invoice and pay the VAT. You supply the product to us and receive your share of the proceeds.
3. What you earn
- For each sale you receive the sale price excluding VAT, minus a commission of 7%.
- A sale becomes payable 14 days after purchase.
- We pay out once a month to your IBAN, once your balance is at least € 50.
- If a sale is refunded or charged back, we deduct your share of it from your balance.
- For each payout we create a statement that serves as your invoice (self-billing). You agree that we draw it up on your behalf. Whether VAT applies depends on your situation; set this in your shop settings. Your own tax return remains your responsibility.
4. What you may offer
You only offer digital work you made yourself or hold all the necessary rights to. Your product:
- works, is complete and matches your description;
- contains no viruses, harmful code or hidden tracking;
- does not infringe anyone else’s rights (copyright, trademarks, image rights, privacy);
- is not unlawful, misleading, discriminatory or adult content.
We review new creators and products before they go live. We may refuse a product or take it offline if it breaks these rules or if someone makes a well-founded report. We will tell you why, and you can object via [email address].
5. Your rights stay yours
All copyright and other rights in your products remain yours. You only give Cre8ify permission to store, display, sell and deliver your products, and to promote them using your name, images and short excerpts. This permission is non-exclusive: you may also sell your work elsewhere.
Buyers receive a licence as stated in your product description. If you state nothing, it is for personal use. Buyers keep their licence even if you stop later.
If someone claims your product infringes their rights, you are responsible and you indemnify Cre8ify against resulting damages and costs.
6. Buyer questions
Cre8ify handles payments, invoices, downloads and refunds. You answer questions about the content of your product within a reasonable time.
7. Buyer data
You see buyers’ names and what they bought. You use that data only to help them with your product. You do not use it for marketing without their consent and you share it with no one. You comply with the GDPR.
8. Stopping
You can stop at any time by taking your products offline and emailing us. We can end the agreement with 30 days’ notice, or immediately in case of a serious or repeated breach. We pay out your balance after the 14-day holding period.
9. Liability
Cre8ify is not liable for indirect damage or lost turnover, for example due to outages. Our total liability is limited to the commission we received from you in the preceding 12 months, except in cases of intent or gross negligence.
10. Changes and law
We may change this agreement. We announce important changes, such as the commission, at least 30 days in advance; if you disagree, you can stop. This agreement is governed by Dutch law.
